A Florida man has been arrested after throwing a live alligator into a Wendy’s restaurant, according to the Florida Fish and Wildlife Conservation Commission.

23-year-old Joshua James, was picking up his order before grabbing a 3-and-a-half foot gator from the back of his truck.

After receiving his drink he allegedly tossed the reptile through the window while the server’s back was turned, according to a Florida Fish and Wildlife Conservation Commission Incident report.

The incident took place in October, however James was only taken into custody on Monday by U.S. Marshals, according to WPTV.

The station also reported that surveillance video led to his arrest.

FWC officials said James admitted to picking the alligator up from the side of the road and bringing it to the Wendy’s.

The alligator was released into a nearby canal, according to WPTV.
