Emma Czornobaj : Woman who caused accident helping ducks faces prison

A woman convicted in the death of a motorcyclist and his daughter who crashed into her car when she stopped to help a family of ducks will be sentenced on December 18.

At her criminal trial earlier this summer, she was found guilty on two counts of criminal negligence causing death and two counts of dangerous driving causing death.

The Crown asked for a nine-month sentence in prison, 240 hours of community service and a five-year ban on driving.

Crown prosecutor Annie-Claude Chassé says the sentence takes into account her age – she was 21 at the time of the crash – the fact that no speeding, alcohol or racing was involved, and her lack of criminal record.0

Czornobaj’s attorney Marc Labelle asked for no jail time, just community service.

He argued that there was nothing that could be done to help the victims – although he repeated his assertion that André Roy was speeding at the time of the crash. But he urged judge Eliane Perreault not to use the court as a tool of vengeance.

He said Czornobaj cooperated with police, and remains consumed by guilt and remorse.

She is unable to find a job, and the John Molson School of Business grad – her graduation day was the same day as the start of her trial – makes her living cleaning houses when she can.

Labelle argues she has suffered enough.

    1. Maybe she’s unable to find a job because she’s incompetent, not because she’s been inconvenienced by a criminal trial. And the bit about the victims speeding is precious — I rehash the oft-uttered phrase of speed not being the issue, but the sudden stop, and it’s clear who’s responsible for causing the sudden stop.

    2. Yes a tragedy, but, when you are behind someone, you HAVE to be prepared at all times to stop, regardless of the reason; ducks, a human, it dont matter, the person in front sets the speed, not the guy on the bike. If he was the proper distance behind her, not speeding, and paying attention (all three of those things which any driver should be doing ALL the time) him and his daughter would be alive. Its sad this woman may face prison time because of a hotdog on two wheels.

      • The bike rider from what I understand was not following the girl mentioned above but another driver who also approached the above girls car which was already stopped and blocking a lane on a busy highway and without warning swerved to avoid hitting the parked car which did not give the bike rider time to avoid or notice the girls car was empty and not moving. The bike rider had no warning and nowhere to go when he and his daughter on the back then hit the back of the parked car. Who in their right mind gets out of their car on a busy highway to help ducks cross the road while leaving themselves and other road user at risk of death or injury.
