Richard Chan charged with manslaughter after assault victim dies

Toronto police say charges have been laid after a 60-year-old man was found dead in an apartment near Gerrard Street East and Woodbine Avenue last month.

The accused, 50, was arrested on Tuesday, Nov. 10, and charged after the death which took place on Oct. 16.

According to police, they were called to an apartment in the area on Oct. 2 to deal with a reported altercation. When police arrived, they found a 60-year-old man, identified as Charles Smithers, suffering from broken ribs after he had allegedly been kicked in the back.

On Oct. 16, police were called to the same apartment for the report of a sudden death. The man who had died was Smithers, the victim of the earlier alleged assault.

A post-mortem determined Smithers had died as a result of his injuries suffered in the earlier incident, police said.

Richard Chan, 50, has been charged with manslaughter.
